Terms of Service

Calos: AI Calorie Tracker — Effective date: February 28, 2026

These Terms of Service ("Terms") govern your access to and use of the Calos: AI Calorie Tracker mobile application and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) The Service

Calos helps you track food intake and provides AI-generated estimates such as calories and macronutrients ("Nutrition Estimates"). You can log meals manually and/or submit meal photos for analysis.

Important: Nutrition Estimates are informational only and may be inaccurate. The Service is not a substitute for professional medical advice, diagnosis, or treatment.

2) Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority where you live, you represent that a parent or legal guardian has reviewed and agreed to these Terms.

3) Accounts and access

The Service may allow use with or without an account, depending on your version/build. You are responsible for maintaining the confidentiality of any credentials you use and for all activity under your account or device.

4) Your content and inputs

You may provide information such as meal descriptions, quantities, notes, and meal photos ("User Content").

You retain ownership of your User Content. However, to operate the Service, you grant Calos a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display User Content only as necessary to:

5) AI features and photo analysis

If you submit a meal photo or related details for analysis, you instruct Calos to process that information (including by using third-party AI providers) to produce Nutrition Estimates.

Some features may require a paid subscription ("Premium"). Pricing and billing terms are shown in the app at the time of purchase.

If you purchase Premium through Apple In-App Purchase (or another app store):

No refunds are provided by Calos unless required by law. Refund requests, when available, are handled by the app store under its policies.

You agree not to:

8) Health and safety disclaimer

Calos does not provide medical care. The Service does not diagnose, treat, cure, or prevent any disease.

Always seek the advice of a qualified health professional with any questions about your health or diet. Never disregard professional advice because of something you read or receive through the Service.

If you think you may have a medical emergency, contact emergency services immediately.

9) Intellectual property

The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by Calos or its licensors and is protected by intellectual property laws.

You receive a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms.

10) Third-party services

The Service may rely on or link to third-party services (e.g., app stores, payment processors, analytics, AI providers). Your use of those third-party services is governed by their own terms and policies. Calos is not responsible for third-party services.

11) Privacy

Your use of the Service is also governed by our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy controls.

12) Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we are required to do so for legal or security reasons.

Termination does not affect any rights or obligations that by their nature should survive, including intellectual property, disclaimers, limitation of liability, and dispute provisions.

13) Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available." Calos disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

To the maximum extent permitted by law, Calos will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Service.

To the maximum extent permitted by law, Calos's total liability for any claim arising out of or relating to the Service will not exceed the amount you paid (if any) for the Service in the 12 months before the event giving rise to the claim, or €50, whichever is greater.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Calos from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from or related to:

We may modify the Service or these Terms from time to time. If we make material changes, we may provide notice in the app or by other reasonable means. By continuing to use the Service after changes become effective, you agree to the updated Terms.

17) Governing law and disputes

These Terms are governed by the laws of the country/region where the Service provider is established, excluding conflict-of-law rules.

If you live in the EEA/UK, you may also have mandatory consumer rights and may bring claims in your local courts as applicable.
